These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") govern the contractual relationship between, on the one hand, the company STEAM AND VAPE, a French limited liability company (SARL) with a share capital of €8,000, whose registered office is located at 37 rue des Pierres Missigault, ZA La Torche, 28630 Barjouville (France), registered with the Trade and Companies Register of Chartres under number SIREN 795 351 063, and on the other hand, any non-trading natural person of legal age, or any legal entity, making a purchase via the website www.steam-and-vape.fr, hereinafter referred to as the "Buyer".
These GTC specify, in particular, the terms and conditions of ordering, payment, delivery, returns management, withdrawal, warranty and after-sales service applicable to the products offered for sale on the website. They are accessible at any time on the website and shall prevail, where applicable, over any other version or any other conflicting document.
Validation of an order by the Buyer constitutes unreserved acceptance of these General Terms and Conditions of Sale.
ARTICLE 1. PURPOSE
These General Terms and Conditions of Sale (GTC) are intended to define the contractual rights and obligations between STEAM AND VAPE and the Buyer (whether a consumer or a professional) in the context of the purchase of products via the online store at www.steam-and-vape.fr.
These GTC apply, without restriction or reservation, to all sales concluded between STEAM AND VAPE and the Buyer through the website. The purchase of a product implies full and unconditional acceptance of these GTC, which shall prevail over any other general or special conditions not expressly approved by STEAM AND VAPE.
STEAM AND VAPE reserves the right to amend these GTC at any time. In such a case, the applicable conditions will be those in force and accessible online on the date the Buyer places the order.
ARTICLE 2. THE BUYER
The Buyer must be a natural person of legal age (18 years or older) and legally capable of entering into a contract, or a legal entity represented by an authorized person. In accordance with applicable regulations, the sale of vaping products is strictly prohibited to minors.
The Buyer agrees to provide accurate, complete, and up-to-date personal information, particularly regarding billing and shipping details. The Buyer is solely responsible for the information entered when placing the order. STEAM AND VAPE cannot be held liable for any delivery failure or improper execution of the contract resulting from errors or omissions in the information provided by the Buyer.
In the event of serious doubt regarding the identity of the Buyer, the accuracy of the information provided, or the good faith of the order, STEAM AND VAPE reserves the right to refuse or cancel any order. It may also suspend or delete a customer account in case of violation of these terms and conditions.
ARTICLE 3. CHARACTERISTICS OF THE PRODUCTS OFFERED
The products and services offered for sale are those listed in the online catalog available on the website www.steam-and-vape.fr.
It is the responsibility of the Buyer to check with the local authorities in their country of residence or delivery regarding the import, possession, and use of the ordered products. STEAM AND VAPE cannot be held liable for any failure to comply with applicable regulations in the country of destination, particularly regarding nicotine content or volume limits, or import restrictions.
Products are offered within the limits of available stock. Each item is accompanied by a description provided as accurately as possible, based on information supplied by the manufacturer or supplier. Images, text, and technical specifications are provided for informational purposes only and are not contractual. STEAM AND VAPE declines all responsibility for any obvious errors or minor discrepancies between displayed visuals and the delivered product (including color, shape, or dimensions).
The Buyer is solely responsible for the selection of products and their suitability for their needs. The Buyer agrees to use the products in accordance with the instructions and precautions provided in the user manuals. STEAM AND VAPE cannot be held liable for improper use, misuse, or use in combination with unsuitable products.
Certain electronic devices sold may contain substances that are hazardous to human health or the environment. They must not be disposed of with unsorted household waste and must be collected through dedicated channels (see Article 15 – WEEE). The use of electronic cigarettes is prohibited for minors and not recommended for pregnant or breastfeeding women, or for individuals with cardiovascular, respiratory, or neurological conditions.
ARTICLE 4. PRICES AND RATES
The prices listed in the catalog are expressed in euros (€), inclusive of all taxes (VAT included), and reflect the VAT rate applicable on the date of the order. Any change in the legal VAT rate may be reflected in the final price of the products.
STEAM AND VAPE reserves the right to modify its prices at any time. However, the applicable price for the Buyer is the one indicated at the time of the final validation of the order.
In the event of a mistakenly displayed price that is clearly abnormally low (commonly known as a "derisory price"), regardless of the cause (technical, IT, or human error), STEAM AND VAPE reserves the right to cancel the order. The contract shall be deemed null and void, and any amounts already paid shall be fully refunded to the Buyer.
The prices displayed on the website do not include order processing, shipping, or delivery fees. These additional costs are billed separately and specified prior to the final confirmation of the order. The total amount payable by the Buyer, including these charges, is clearly displayed before the payment stage.
All payments are made in euros (€). In the event of payment in another currency, any applicable conversion fees, bank charges, or additional costs are the sole responsibility of the Buyer.
For deliveries to countries within the European Union, STEAM AND VAPE applies the VAT rate in effect in the destination country, in accordance with the One-Stop Shop (OSS) scheme. The total amount including tax is automatically calculated and displayed at checkout.
For orders shipped outside the European Union, invoices may be issued excluding taxes (net of VAT). In such cases, the Buyer is considered the official importer and shall be solely responsible for any customs duties, import taxes, or handling fees applicable upon arrival, in accordance with the laws in force in the country of destination. These fees are the sole responsibility of the Buyer and cannot be reimbursed by STEAM AND VAPE.
ARTICLE 5. COMMANDES
Any Buyer wishing to purchase a product on the website www.steam-and-vape.fr must complete the following steps:
- Fill in the online identification form with complete, accurate, and up-to-date information;
- Select the desired products and their variations (quantity, size, color, etc.);
- Review the contents of the shopping cart and correct any errors before confirming the order;
- Confirm having read and accepted these General Terms and Conditions of Sale (GTC) by checking the appropriate box;
- Make the payment using one of the available methods listed on the website;
- Confirm both the order and the payment to finalize the transaction.
Confirmation of the order by the Buyer implies full and unconditional acceptance of these GTC, acknowledgment of their full understanding, and waiver of any contrary conditions or documents.
In accordance with Article L.221-14 of the French Consumer Code, the order is considered final only after a two-step confirmation process: an explicit validation of the order (click to order) followed by payment (click to pay), and the subsequent receipt of an order confirmation email sent by STEAM AND VAPE.
All data entered, as well as the electronic confirmation recorded, shall constitute proof of the transaction in accordance with Article 1366 of the French Civil Code. These shall serve as proof between the parties, particularly concerning the date, content, and amount of the order.
ARTICLE 6. PAYMENT
The price of the products is payable in full at the time the order is placed. Payment is made exclusively online by credit card via the following secure platforms: CM CIC P@iement (SSL protocol and 3DSV2 authentication), Alma, or Fintecture. These systems ensure the confidentiality and security of transmitted data, which is encrypted and protected during transfer over the network.
For customers residing in the eurozone (excluding France), STEAM AND VAPE also offers payment by SEPA bank transfer. The bank details (RIB) are provided at the end of the ordering process. The transfer must be made within five (5) business days of the order. If the funds are not received within this period, the order will be automatically canceled without further notice.
STEAM AND VAPE reserves the right to temporarily or permanently disable the SEPA bank transfer payment option for any customer in the event of abuse or behavior intended to block inventory without genuine intent to pay.
The Buyer's bank account is debited immediately and in full at the time of order. STEAM AND VAPE does not offer a pre-order system: only products marked as available can be ordered and paid for.
STEAM AND VAPE reserves the right to suspend or cancel any order in the event of payment refusal, non-payment, or suspected fraud.
An electronic invoice detailing the elements of the order, including the amount of applicable VAT, will be sent to the Buyer by email. The Buyer expressly agrees to receive their invoice in electronic format, in accordance with Article 289 of the French General Tax Code.
Products remain the property of STEAM AND VAPE until full payment of the purchase price by the Buyer.
ARTICLE 7. DELIVERY
Delivery costs are borne by the Buyer. They include contributions to preparation, packaging, and postage fees. Any customs duties, local taxes, or bank charges related to importation are also the sole responsibility of the Buyer.
Deliveries are made to the address provided during the order process, exclusively within the geographical zones served by STEAM AND VAPE. The Buyer is responsible for the accuracy and completeness of the information provided. In the event of an incomplete or incorrect address, STEAM AND VAPE cannot be held liable for failure to deliver the order.
Products are shipped at the seller’s risk until delivery to the customer or a designated third party, in accordance with Article L.216-4 of the French Consumer Code. From the moment the package is handed over in person or deposited in the recipient’s mailbox, the risks are transferred to the Buyer.
In the event of damage noted upon receipt, the Buyer must notify STEAM AND VAPE within 72 hours of delivery by email at contact@steam-and-vape.fr, via the contact form on the website, or by postal mail (postmark serving as proof). This declaration must include:
- One or more photographs clearly showing the damage;
- A sworn statement signed by the Buyer describing the damage or tampering;
- A copy of the Buyer's ID;
- A copy of the official report filed with the carrier regarding the damage or tampering.
After review and validation by STEAM AND VAPE, a prepaid return label may be provided to the Buyer for the return of the affected items only. If the damage is confirmed, the Buyer may choose between:
- A refund of the value of the damaged goods as of the purchase date; or
- A store credit of the same value, usable on a future order.
If a package is returned due to prolonged absence, failure to collect, or an incomplete address, the delivery fees will not be refunded. Only the product value will be refunded, minus any applicable costs. No refund will be issued for returns in the following cases:
- Unclaimed packages at the postal service within the deadline;
- Voluntary refusal by the recipient;
- Incorrect or incomplete address provided during checkout.
Delivery times are provided for information purposes only. Under Article L.216-1 of the French Consumer Code, if delivery is not made within thirty (30) days from the order date (except in the case of force majeure), the Buyer may request cancellation of the sale and receive a full refund.
Force majeure is defined as any unforeseeable, irresistible, and external event under Article 1218 of the French Civil Code, including (but not limited to): strikes, extreme weather, epidemics, customs delays, armed conflict, fire, flooding, or supply chain disruptions.
Deliveries within the European Union
For deliveries to EU member countries, STEAM AND VAPE applies the VAT rate in force in the destination country, in accordance with the One-Stop Shop (OSS) scheme. This rate is automatically applied during checkout and shown on the invoice.
Deliveries outside the European Union
For deliveries outside the EU, orders are invoiced exclusive of VAT. The Buyer is considered the official importer in their country of residence and is solely responsible for paying any customs duties, local taxes, import or handling fees. These fees are not collected or refunded by STEAM AND VAPE.
International delivery times may vary depending on customs clearance procedures and local courier operations. STEAM AND VAPE cannot be held responsible for delays due to inspections or border hold-ups.
If the package is refused or the applicable import charges are not paid upon delivery, it may be returned to the sender. In such cases, the return costs and any customs or postal penalties will be deducted from the refund due to the Buyer.
It is the Buyer’s responsibility to verify the compliance of the ordered products with the regulations in effect in the country of delivery. No refund or compensation will be issued in the event of seizure, destruction, or customs blocking of the package.
Click and Collect (In-Store Pickup)
Under the in-store pickup service ("Click and Collect"), the order is made available to the Buyer at STEAM AND VAPE’s premises. Ownership and liability for the goods transfer to the Buyer on the date they are made available. The Buyer assumes responsibility for the goods from that date forward.
ARTICLE 8. RIGHT OF WITHDRAWAL
In accordance with Article L.221-18 of the French Consumer Code, the Buyer, acting as a non-professional individual and residing within the European Union, has a period of fourteen (14) days from the date of receipt of the order to exercise their right of withdrawal, without having to justify any reason or pay any penalty.
This right can be exercised by contacting STEAM AND VAPE by email at contact@steam-and-vape.fr or via the contact form available on the website, before the expiration of the legal withdrawal period. The return of the products must then be carried out within fourteen (14) days from the date of the notification.
Return shipping costs are exclusively borne by the Buyer. The risks associated with return transport (loss, damage, delay) remain the sole responsibility of the Buyer until the products are received by STEAM AND VAPE.
Returned products must be in perfect resalable condition, in their original, unopened packaging, and accompanied by all accessories, manuals and documentation. STEAM AND VAPE reserves the right to refuse a return that does not comply with these conditions.
In accordance with Article L.221-28 of the French Consumer Code, the right of withdrawal does not apply to:
- products unsealed after delivery that cannot be returned for hygiene or health protection reasons, such as e-liquids, DIY bases, or flavor concentrates;
- sealed hardware such as atomizers, clearomizers, drippers, or drip tips, once opened;
- artisanal or high-end products delivered without a seal, if they have been used or handled.
If all the above conditions are met, STEAM AND VAPE will proceed, at the Buyer's choice, with either a refund of the returned product(s), or an exchange. Refunds will be made within a maximum of fourteen (14) days from receipt of the returned goods or proof of shipment provided by the Buyer, whichever comes first.
In accordance with Article L.221-5 of the French Consumer Code, the Buyer may use any standard withdrawal form provided by applicable regulations. However, this formality is not mandatory: any written and explicit request will be considered valid, regardless of its format.
The right of withdrawal applies only to orders delivered within the European Union. For customers residing outside the EU, returns are not accepted by default and will only be considered on a case-by-case basis, subject to prior written agreement with STEAM AND VAPE.
ARTICLE 9. WARRANTY
STEAM AND VAPE is liable for any lack of conformity of the goods under the conditions provided in Articles L.217-3 et seq. of the French Consumer Code, as well as for hidden defects under Articles 1641 et seq. of the French Civil Code.
In this respect, the Buyer may submit a claim:
- under the legal warranty of conformity, within two (2) years from the date of delivery of the goods;
- or under the warranty against hidden defects, within two (2) years from the discovery of the defect.
When acting under the legal warranty of conformity, the Buyer:
- has a period of two (2) years from delivery to take action;
- may choose between repair or replacement of the product, subject to the cost conditions outlined in Article L.217-12 of the French Consumer Code;
- is not required to prove the existence of the conformity defect during the two (2) years following the delivery of the goods (twelve (12) months for second-hand goods).
The legal warranty of conformity applies independently of any commercial warranty that may be offered. The Buyer may also invoke the warranty against hidden defects as defined in Article 1641 of the French Civil Code. In such case, the Buyer may choose between the cancellation of the sale or a reduction of the purchase price in accordance with Article 1644 of the Civil Code.
Some products sold by STEAM AND VAPE have a naturally limited lifespan. This includes:
- e-liquids, bases, and flavorings, which have a BBD (best before date) stated on the product;
- coils and cartridges, with an average lifespan of two to three weeks;
- batteries and integrated battery devices, whose performance typically declines after approximately 300 full charge cycles.
In accordance with Article L.217-7 of the French Consumer Code, the presumption of non-conformity within 24 months of delivery may be overturned for these products when the defect is due to normal wear and tear.
If non-conformity is confirmed, the product may be returned to STEAM AND VAPE, which will proceed, as applicable, with an exchange, refund, or repair. Any warranty claim must be made by email at contact@steam-and-vape.fr or via the contact form on the website.
Warranty Exclusions
The warranty does not cover defects resulting from misuse, non-compliance with safety instructions, or inadequate maintenance. The following are excluded:
- products that have suffered shocks, falls, oxidation, contact with unsuitable liquids, or extreme temperatures;
- products modified, disassembled, repaired, or altered by the Buyer or an unauthorized third party;
- products used under abnormal conditions or not as intended by the manufacturer;
- defects due to improper connections or unsuitable power supply (overvoltage, short-circuit);
- visible damage (apparent defects) not reported upon receipt;
- lack of maintenance in accordance with the instructions provided in the manual or on the packaging.
In accordance with Article L.217-11 of the French Consumer Code, for deliveries made within the European Union, return shipping costs are borne by STEAM AND VAPE if the defect is confirmed under the legal warranty.
For deliveries outside the European Union, return shipping costs remain the responsibility of the Buyer, unless otherwise agreed or unless STEAM AND VAPE grants a prior express waiver.
ARTICLE 10. LIABILITY
In the context of online sales, STEAM AND VAPE is bound by an obligation of means. It shall not be held liable for damages resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruptions, or any other technical issues beyond its control.
STEAM AND VAPE shall not be held liable for indirect, unforeseeable, or immaterial damages (such as loss of business, loss of opportunity, loss of data, or moral prejudice), resulting from the use of the website or the temporary inability to access it.
Furthermore, STEAM AND VAPE shall not be held liable for non-performance or improper performance of the contract attributable either to the Buyer, a third party, or a case of force majeure within the meaning of Article 1218 of the French Civil Code.
STEAM AND VAPE shall only be held liable for direct, personal, and certain damages suffered by the Buyer, resulting from proven fault in the performance of its contractual obligations.
STEAM AND VAPE declines all liability:
- with regard to the choice of products by the Buyer, especially if they do not meet their needs;
- in case of modifications or improper use of the products;
- in the event of non-compliance with safety and usage instructions;
- in case of damages resulting from poor maintenance, lack of supervision, or inadequate electrical protection;
- or in the event of damage related to improper storage or transportation of the products after delivery.
STEAM AND VAPE is not considered the manufacturer within the meaning of Articles 1245 et seq. of the French Civil Code, unless expressly indicated for specific products. In the event of damage caused by a manufacturing defect, the Buyer must seek redress directly from the relevant manufacturer.
In any case, if STEAM AND VAPE were found liable, the total amount of compensation due shall not exceed the invoiced value of the products concerned, regardless of the legal basis or procedure used.
No compensation shall be granted without the Buyer providing the corresponding purchase invoice.
In the case of purchases made for professional purposes, STEAM AND VAPE shall not be liable for any indirect damages, loss of business, revenue or clientele, or data loss resulting from the use of the products sold.
ARTICLE 11. INTELLECTUAL PROPERTY
All elements appearing on the website www.steam-and-vape.fr — including texts, images, graphics, logos, icons, sounds, videos, software, source code, and databases — are the exclusive property of STEAM AND VAPE or are used under a lawfully acquired usage right.
Any reproduction, representation, modification, publication, transmission, alteration, adaptation, or exploitation, in whole or in part, of the website or any of its elements, by any means whatsoever, without the prior written authorization of STEAM AND VAPE, is strictly prohibited. Such actions constitute infringement within the meaning of Articles L.335-2 and following of the French Intellectual Property Code and may incur the civil and criminal liability of the offender.
Users are authorized to create a simple hyperlink to the website's homepage, provided that such a link does not harm the image or rights of STEAM AND VAPE and does not aim to frame or hijack content (framing, inlining, etc.). Deep linking or automated redirection is prohibited without the express prior agreement of STEAM AND VAPE.
ARTICLE 12. PERSONAL DATA
STEAM AND VAPE collects and processes the personal data of Buyers in accordance with the applicable regulations, including the General Data Protection Regulation (GDPR – EU 2016/679) and the amended French Data Protection Act no. 78-17 of January 6, 1978.
The data collected is used exclusively for the management of orders, deliveries, customer service, and, where applicable, for commercial communications, subject to the Buyer’s prior and explicit consent.
Personal data is never sold or transferred to third parties. However, it may be transmitted to service providers contractually engaged by STEAM AND VAPE (such as carriers or payment service providers), strictly for the purpose of executing and tracking orders. These providers are bound by a confidentiality obligation and act solely on instructions from STEAM AND VAPE.
In accordance with Articles 15 to 22 of the GDPR, any user has the right to access, rectify, erase, restrict, object to, and request portability of their personal data. These rights may be exercised at any time by contacting STEAM AND VAPE at the following address: contact@steam-and-vape.fr.
STEAM AND VAPE retains personal data only for the time strictly necessary to achieve the purposes for which it was collected, unless legal obligations require a longer retention period. The data is hosted securely, exclusively in France or within the European Union.
STEAM AND VAPE may contact its customers by phone for commercial purposes. In accordance with Article L.223-2 of the French Consumer Code, if you do not wish to receive telephone solicitations, you can register free of charge on the national opt-out list available at www.bloctel.gouv.fr.
The Buyer also has the right to lodge a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL) if they believe that their rights have not been respected. For more information: www.cnil.fr.
ARTICLE 13. ORDER AND INVOICE ARCHIVING
STEAM AND VAPE archives order forms and invoices on a reliable, secure, and durable medium, constituting a faithful copy, in accordance with the provisions of Article 1366 of the French Civil Code relating to the evidentiary value of electronic documents.
The computerized records of STEAM AND VAPE, stored in its IT systems under reasonably secure conditions, will be considered as proof of communications, orders, payments, and transactions between the parties.
These documents are retained for the legally required period, for contractual, accounting, and tax-related evidentiary purposes.
ARTICLE 14. DISPUTE RESOLUTION
In accordance with Article L.612-1 of the French Consumer Code, the Buyer has the right to seek free recourse to a consumer mediation service in order to resolve amicably any dispute with STEAM AND VAPE.
STEAM AND VAPE is a member of the CM2C – Centre de la Médiation de la Consommation de Conciliateurs de Justice, a consumer mediation body approved by the Commission for the Evaluation and Monitoring of Consumer Mediation (CECMC).

Until 19 July 2025, consumers may also, on a transitional basis, use the European Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr. This platform will be permanently deactivated as of 20 July 2025, in accordance with Regulation (EU) 2024/3228.
After this date, consumers seeking advice on out-of-court resolution of cross-border disputes are invited to consult the resources available on the European portal: Your Europe.
If mediation fails or if the Buyer chooses not to pursue it, any dispute arising from the present General Terms and Conditions of Sale shall be submitted to the competent French courts, unless otherwise provided by mandatory legal provisions.
ARTICLE 15. WASTE ELECTRICAL AND ELECTRONIC EQUIPMENT (WEEE) COLLECTION
In accordance with Articles R.543-180 et seq. of the French Environmental Code, STEAM AND VAPE offers free take-back of old electrical and electronic equipment (WEEE) when purchasing an equivalent item (“one-for-one”), provided that the returned product is of the same type and performs the same function as the purchased item.
For purchases collected or made directly in-store, the take-back can be done free of charge on-site, at the time of purchase or within a reasonable period thereafter.
For purchases made remotely, the Buyer may also drop off old equipment in-store free of charge. If unable to travel, the Buyer may return the equipment to STEAM AND VAPE at their own expense, subject to prior approval from our customer service team. Returned products must be clean, complete, and safe for transport.
This return service is available in-store or by postal return for customers residing in France. Customers residing abroad (within or outside the European Union) may also benefit from this service under the same conditions, provided they return the used equipment at their own expense, after prior agreement with our customer service.

In accordance with current regulations, used electrical and electronic equipment must not be disposed of with unsorted household waste. They must be subject to specific treatment and recycling procedures.
Governing Language and Authenticity
These General Terms and Conditions of Sale have been translated into English for informational purposes only. In case of any discrepancy, inconsistency, or dispute regarding their interpretation or legal effect, the original French version shall prevail and be deemed the only legally binding version between the parties.
